Strafrechtliche Verfolgung von Vorurteilskriminalität

The work contains an in-depth empirical analysis of the criminal prosecution of bias crimes by the police, public prosecutors and courts. In particular, it focuses on the question of how the addition of inhuman motives and aims to Section 46 (2) sentence 2 of the German Criminal Code has affected the prosecution of prejudice crimes. In order to determine this, a comprehensive file analysis was carried out. The study comes to the conclusion that there are still various challenges both in investigations in the context of bias crime and in the application of the addition of Section 46 (2) sentence 2 StGB. The study therefore concludes with several recommendations for practice.
