What are the obligations of a German entrepreneur when recruiting suppliers? What is customary? What influence do which regulations have? Are there also obligations under criminal law? The author explores these questions by fundamentally researching the origins of criminal law duties of care. A model is developed with which criminal law duties of care can be justifiably derived. The author explores the idea of the principle of responsibility and takes a stand on the doctrine of the prohibition of recourse. Finally, implications for the doctrine of guarantor duty are considered. With the help of the model developed, the dynamic topic of supply chain management is explored.
