The system of cross-compliance/conditionality makes the payment of agricultural subsidies subject to the condition that certain socially desirable requirements, such as animal welfare requirements, are met. The work addresses the question of the extent to which violations of such requirements within the framework of national and European agricultural subsidy law can lead to criminal liability when applying for subsidies.
The starting point for the considerations is the high proportion of agricultural subsidies in the EU budget, so that monitoring and criminal sanctions in the event of misuse appear to be self-evident and absolutely necessary in order to ensure effective use.
