The Federal Labor Court has declared its case law on the internal compensation of damages to be in line with collective agreements. This work shows that practice is unimpressed by this - numerous collective agreements contain a wide variety of provisions that aggravate liability to the detriment of employees. For the first time, this work sheds light on the limits of how far and which liability provisions are permissible in collective agreements. Based on an examination of the requirements and limits of collective bargaining law, concrete regulatory limits are derived for a wide variety of liability constellations. This study offers a unique orientation on liability clauses for theorists and practitioners of collective bargaining autonomy.
