The continuation of collective agreements after the transfer of business is related to various practical problems, which cause high legal uncertainty that needs to be resolved.
By implementing § 613a Abs. 1 S. 2–4 BGB into the collective bargaining law, Sandy Siegfanz-Strauß works out the elementary questions and presents consequent and reasonable solutions which also meet national and European legal standards. This rationale is implemented by making use of several methodical approaches. Through this, § 613a Abs. 1 S. 2–4 BGB provides a consequent and practical system. The key to the here developed interpretation line is the legal form of the normative provisions of collective agreements after the transfer of business as content of the employment relationship and the perpetuation of its collective character.
