Tarifwidrige Regelungsabreden und gewerkschaftliche Durchsetzungsmöglichkeiten

This thesis examines the legal remedies available to trade unions against agreements deviating from collective agreements and presents the approaches developed in case law and academic literature. It focuses on the various procedural options available against workplace parties and the opposing bargaining party. The study sets out – based on a broad analysis of case law and academic literature – the relevant instruments, examines their requirements and scope, and develops its own position. The different approaches are brought together in an overall perspective and systematically assessed.
