This thesis examines possible ways to ensure that future updates of collective bargaining agreements will apply after a transfer of undertakings. Such measures are often desired by employees, usually represented by works councils or trade unions, since the German law only provides for the ­application of collectively agreed rules that are in force at the date of the transfer. The author discusses the validity and the temporal scope of various security agreements. In addition, the author examines which parties – transferor, transferee, works council, trade union or employee – can enter into such agreement, and, in particular, whether agreements can also be enforced by a trade union through strike action.
