Description
Free trade is for Israel the key to a balanced foreign trade. The legal framework for trading with Israel – the international commitments, domestic legislation and administrative acts – is evaluated accordingly. The study advocates judicial review, by the Israeli Courts, of trade-related administrative acts, that takes account of Israel"s commitment to free trade under the free trade agreement (FTA) with the EEC. This approach deviates from the present practice to disregard treaties that were not first transformed into the domestic legal system. Finally, this study suggests principles that should underlie final legal decisions on such matters. German summary included.
