Transnationale Regelungen im Verbandssanktionenrecht

Jurisdictional conflicts regarding the prosecution of crimes committed by transnationally operating business enterprises create problems for law enforcement agencies as well as for the affected companies. It would therefore be desirable to determine in advance which state(s) should exercise jurisdiction in such trans-border cases. The author seeks to establish guiding principles for the allocation of jurisdiction on trans-border corporate offenses and develops solutions for the resolution of conflicts between states. She suggests the introduction of a coordinated approach based on an international convention.
