“The Supervision of Offshore Liability Rules” analyses the compensation mechanism which applies in case of delay, disruption or maintenance of grid connections for offshore wind farms, and examines how the mechanism is supervised. Offshore liability rules protect offshore wind farm operators against investment risks, while also limiting liability risks incurred by transmission system operators, who are obliged to construct and operate grid connections. The compensation granted to wind farms is financed by final consumers by means of an “offshore liability surcharge”. This support scheme is subject to private law and managed by its beneficiaries, which makes it susceptible to conflicts of interest. Using a principal-agent approach, the book examines whether offshore liability rules are sufficiently supervised to ensure that final consumers are effectively protected against excessive surcharge payments. On this basis, it suggests improvements for future surcharge mechanism design.
