Under EU law, personal data may only be transferred to a third country, if the third country, e.g. the U.S., guarantees an adequate level of data protection. In 2015, the CJEU has held that adequacy decisions must also take into account the third country’s rules on foreign intelligence surveillance.
In this spirit, the book analyzes the U.S. law governing the mass collection of telephone and internet data by U.S. intelligence agencies. While the study refutes the misconception that U.S. intelligence agencies operate in a legal void, it shows the serious flaws of the current constitutional and statutory regime. Considering the strengths and weaknesses of post-Snowden reforms, the book discusses, which role constitutional law and constitutional adjudication play in a time when technological advances rapidly change the methods of government surveillance.
An annex contains key documents and cases on U.S. foreign intelligence surveillance law.
