Ungesichert bei Krankheit

The work deals with the situation of people without current health protection. The author examines the possibilities for obtaining such health insurance via the contingency insurance (§ 5 Para. 1 No. 13 SGB V), insurance in the basic tariff (§ 193 Para. 3+5 VVG), “quasi-insurance” (§ 48 p. 2 SGB XII in conjunction with § 264 para. 2 to 7 SGB V), assistance in the event of illness (§ 48 p. 1 SGB XII), benefits in the event of illness, pregnancy and childbirth (§§ 4, 6 AsylbLG) and bridging benefits (§ 23 Para. 3 s. 3 et seqq. SGB XII). In doing so, he shows the "hierarchy” of the security systems and the existing gaps in the individual systems. To facilitate access to a security system, the creation of a statutory regulation is necessary. The author proposes a solution for such a legal regulation.
