Unternehmensbeteiligungen von Ärztinnen und Ärzten im Lichte des § 299a StGB

This thesis examines the scarcely explored question of the circumstances under which physicians holding equity interests in healthcare companies may incur criminal liability for bribery in the healthcare sector under Section 299a of the German Criminal Code (StGB). Taking into account principles of corporate, professional and social law, the author analyses the elements of the offence under Section 299a StGB and develops criteria for distinguishing between legitimate entrepreneurial activity and criminal corruption. On this basis, she examines selected case groups and concludes by addressing the specific issues arising in the criminal law assessment of various models of professional cooperation with particular practical relevance.
