Whenever board-level codetermination, which contains the idea of a democratic economy, meets the public principle in municipal corporations, different arguments for or against board-level codetermination get mixed up with various ideas of public democracy. Different fields of law, such as labour, commercial and public law meet in municipal corporations which may lead to tension between these laws. The following studies examine these tensions and show practical solutions. Therefore the studies do not only analyze the meaning of democracy defined in the German constitution (Grundgesetz) but also deals with the question of how the enigmatic term “democracy” can or even must be lived in the pluralistic society of the 21st century.
