The increasing number of corporate criminal proceedings in Switzerland and Austria as well as the reform discussion regarding a German law on association sanctions have led to the fact that both fundamental questions of the responsibility of associations for criminal offences and questions of application have become highly topical and are being discussed controversially.
To mark this occasion, the editors of this publication have held two workshops together with a small group of experts from Switzerland, Germany and Austria at the Universities of Bern and Basel (March 2018/March 2019).
The present publication reflects the results of the intensive discussions on possible models of criminal liability of associations, conditions of liability, sanctions, but also on the procedure and the constitutional guarantees to be observed in this procedure.
