Description
Global economic integration poses new challenges not only for governments but also for companies as well as consumers and raises question regarding the progressive internationalization of criminal law. Supply chain laws to ensure a (human) and just global economy and human rights protection are on the rise. In the context of supply chains, the responsibility of company employees and - de lege ferenda also of companies - under international criminal law could play a leading role in matters of human rights; ideally, this could go as far as protection against exploitation, damages of the environment, slavery and child labour especially in countries of the Global South. Already today, corporate social responsibility (CSR) regulations and soft law have gained significant momentum in terms of due diligence. Sustainability issues such as fraudulent greenwashing (in commodity and financial markets) could also attract law enforcement agencies onto the scene in the near future.
