Urheberrecht in der wissenschaftlichen Forschung: Ein „Window of Opportunity?"

Researchers seek access to scientific knowledge, do research on copyright protected works, have a strong interest in collaborative research and the communication of their findings, and strive for individual recognition and legal certainty.
This study finds that current German copyright law for scientific research, especially in §§ 60c, 87 (1) no. 2 UrhG, cannot accommodate all these interests. In addition to a dogmatic analysis of the law, the analysis contains extensive empirical findings on copyright-relevant uses and interests of researchers as well as suggestions for changes in German scientific copyright law and effective enhancement of researchers’ copyright expertise.
