The methods of medically assisted reproduction for the treatment of unwanted childlessness have developed rapidly in recent decades and are enjoying ever-increasing popularity. So-called heterologous insemination is very often used and discussed. Heterologous insemination occurs if a child is conceived by means of artificial insemination through sperm donation by a third person. As a result, the child’s social and possibly legal father is not identical with their genetically biological father.
Reproductive medicine poses new challenges to the legal system and warrants a review of family law with regard to its topicality. Against this background, this work comprehensively elaborates the legal framework applicable to heterologous insemination, takes into account general questions of modern reproductive medicine, and critically examines and makes concrete proposals for legal reforms.
