Dealing with legacy or perpetual liabilities can lead to significant financial burdens for the public sector if the companies responsible do not ultimately assume them. Following the decision to phase out nuclear power, the legislator has therefore introduced a new form of post-closure liability to ensure that operators bear these costs in the long term. In this volume, the author examines the legal options available to avoid the re-sponsible companies having to bear the costs. He also examines whether the extended liability model intro-duced for the nuclear energy sector is a legal response to these options and therefore ultimately transfera-ble to other sectors of the economy.
