Enforcement deficits of consumer rights are still typical characteristics of consumer law. The question arises how much consumer law enforcement should or must be left to the state and what role should be played by consumer associations in the context of collective legal protection. European legal acts (e.g. the CPC-regulation) also force a readjustment of the consumer enforcement system. Despite an amendment to the Consumer Dispute Resolution Act, the out-of-court settlement of consumer disputes has not yet found its true role in the system of consumer legal protection. For the first time, the possibilities of consumer and social associations as well as administrative authorities and the role of consumer arbitration boards will be systematically examined (in addition to the individual possibilities of legal action). The strengths and weaknesses of current consumer law enforcement become apparent and concrete proposals are made on how deficits can be remedied.
