In recent years, the powers of the police to carry out suspicionless checks on persons have been extended in many federal states. Critics see dangers in the use of discriminatory selection criteria. A particularly farreaching variant is that of suspicionless area checks, whose constitutional framework is elaborated by the author. In particular, she examines which requirements for the legislative design of such control powers result from the principle of certainty and the principle of proportionality. In addition, she explains to what extent the executive police officers are limited by Article 3 (3) of the Basic Law with regard to the controversial method of racial profiling.
