Verfassungsrechtliche Anforderungen an die Finanzierung von Staatshaftungslasten durch Sonderabgaben

In a decision declining to hear the case, the BVerfG upheld the constitutionality of the concept of financing the Federal Financial Supervisory Authority’s (BaFin) state liability obligations through a special levy. Key questions regarding the constitutional admissibility, the theoretical foundations, and the limits of this decision had previously remained unresolved. This thesis provides a fundamental legal-theoretical clarification of the question regarding the constitutional admissibility requirements for such a special levy and demonstrates that the costs of state liability must, in principle, be borne by the state and financed from the general budget. The study concludes with a legal-policy proposal regarding the BaFin levy.
