Verfassungsrechtliche Fragen der Finanzierung der Pflegeausbildung

This paper examines the extent to which the financing system of the Act on the Nursing Professions is compatible with the Basic Law. With the Act on the Nursing Professions the federal legislature has fundamentally restructured not only vocational nursing training but also its financing. Financing is now provided through equalisation funds. The paper first examines in detail whether the Federation has the legislative authority to establish the financing provisions. It will then examine whether the requirements set by the Federal Constitutional Court (Bundesverfassungsgericht) for the imposition of special levies are met. Finally, it will consider whether the financing system is compatible with the right to establish private schools.
