Description
The publication provides an overview of the origins and development of the misappropriation of residential space. The legal framework is also presented in detail and considers the different legislation in the federal states. Since the Federalism Reform I, it has been incumbent on the federal states to enact their own regulations regarding the misappropriation of property. As a result, the states have their own room for discretion, which in some cases has led to considerable deviations from the previous regulations. This paper covers the main deviations and examines them in detail from the perspective of competence and property law. Finally, the results can be looked up particularly quickly thanks to the section-by-section presentation.
