Verhaltens- und verhältnisbezogene Primärprävention und Gesundheitsförderung im Recht der gesetzlichen Krankenversicherung

Prevention and health promotion are of increasing importance in medicine. In recent years, both instruments have again come into focus in statutory health insurance. This doctoral thesis deals with the resulting legal questions. First of all, the fundamental constitutional questions regarding the implementation of these two instruments in the system of statutory health insurance are examined. Afterwards, the problems of the social law regulations are deepened. In this respect, the practical relevance of the provisions of SGB V is often taken into account. The core elements are the design of support and reward services for primary preventive and health-promoting behavior of the insured and - in an overview - also possible malus regulations de lege ferenda. The work also deals with points of contact between social law regulations and labor law.
