Description
Since the ability of software agents to act autonomously is also the cause of autonomous malfunctioning, a legal framework has to regulate compensation for damages caused by autonomous malfunctioning. Appropriate regulation already exists in both contractual and pre-contractual settings; however, it does not exist regarding non-contractual liability. This situation encourages uneconomic and abusive behavior and prevents efficient use of autonomous software. A solution for this problem is a joint and several strict liability, combined with an additional mandatory insurance for software that is particularly prone to danger.
