An essential task of contract law lies in the allocation of risks: If the personal, economic, or legal conditions change to the detriment of one of the contracting parties, contract law is called upon to decide which party has to bear the respective risk. In his study, Thorben Eick first takes an abstract look at the criteria by which German contract law allocates these risks. In the specific context of pandemic-related risks, he then examines whether the risk allocation regime of the German civil code (BGB) can handle the challenges posed by contract risks of social significance.
