Description
Is the Federal Republic of Germany allowed through its visa policy to prevent asylum seekers from a legal and safe entry into the country? Or is it obliged in certain situations to grant asylum seekers access to the asylum process by means of humanitarian visas? With these questions, the study takes aim at the tension between the state's interest in migration control – on the one hand – and the state's human rights obligations towards forcibly displaced persons on the other. As an extraterritorial instrument of control, visa policy raises the controversial question as to the validity of human rights obligations abroad. Under analysis are International law, Europea Union law and German constitutional law.
