This work comprehensively examines and analyses the case law of the European Court of Justice on the internal legal effects of international law norms, which is described in legal literature as dogmatically questionable and politically motivated. In particular, it elaborates on the complex reasons why the Court of Justice is very restrictive in enforcing many rules of international law – such as world trade law, maritime law, or environmental law – in relation to original EU law. These reasons are placed in a broad context of EU constitutional law. Finally, the work attempts to further develop the dogmatics of the Court of Justice in order to counter the broad criticism.
