Vollstreckung ausländischer Entscheidungen in Griechenland

Legislative alignment in the area of European procedural law does not automatically lead to its uniform application. The implementation of the EU provisions on the enforcement of foreign judgments (Brussels I Regulation) poses a methodological challenge for Greek courts. This thesis identifies the causes of implementation deficits and proposes measures for their remediation. The review discusses three conceptual instances: method, application of material law, and procedural implementation. As a result the need for a Greek implementation act for the Brussels I Regulations is justified, and possibilities to adjust the Greek method of interpretation to the European principle of effectiveness are demonstrated. This thesis advocates and aspires to contribute to an enhanced dialogue between EU law and the Greek civil procedure. It is addressed to academics and lawyers in the area of European and international civil procedure as well as legislative alignment in the EU.
