Description
The »Rechtsstaat« in eastern Asia is now changing quickly. This change tends toward a new type of state, which gives up its role as a paternalistic guardian of citizens, cooperates and communicates with citizens on the equal basis. The notion of »cooperative state« reflects the experience that the state is no longer – in contrast to the situation in the 19th and 20th centuries – capable to function as the highest steering mechanism of society.
Under that perspective, this work treats the relating topics such as the changing concept of social rights, the public private partnership, the rights of citizens to information and participation and judicial review as the guardian of rule of law.
