Wettbewerbsrechtliche Probleme kooperativer Energiebeschaffung

The liberalisation of the energy sector has made cooperative energy procurement interesting for enterprises. High energy costs and economic disadvantages compared to large global players are meant to be counteracted by bundling demand. This involves a variety of legal risks. For the first time, a thorough legal analysis of the new forms of purchase is performed in the dissertation. Following the definition of terms, and on the basis of two outlined and typed model procurement forms, the competitive-juridical admissibility of the concepts´ horizontal, vertical and bundle aspects is examined. The analysis of the market context also addresses future market forms in the green electricity sector. Regulatory aspects and aspects of digitalisation and platform building are also addressed and reviewed for their transferability. Finally, practically applicable concrete solutions are developed for the agreements classified as legally questionable.
