In reorganization law, companies are provided with numerous instruments that give them an economic advantage over their competitors: Insolvency benefits, special termination rights, enforcement moratorium, financing effects – failure is rewarded in commercial law. What is a successful reorganization? Do the privileges lead to successful reorganizations? What does this mean for competition?

In this interdisciplinary study, the author combines business management and empirical methods and explores the question of whether a fundamental rethinking of reorganization law is necessary and whether, for the first time, systematic protection of competition should be part of reorganization law.
