Zulässige Unternehmensverteidigung oder strafbare Strafvereitelung?

Case law and literature have long addressed the boundaries of permissible individual defence. In contrast, the question of when the boundaries of permissible corporate defence are exceeded and those involved in corporate defence expose themselves to the risk of criminal liability for obstruction of prosecution or punishment pursuant to Section 258(1) of the German Criminal Code (StGB) has so far received only limited and often superficial attention. This study is dedicated to systematically exploring this question. The analysis focuses on key issues that arise both from traditional debates surrounding individual defence and from practical case scenarios specific to white collar defence.
