Using the example of a famous will in favor of a mistress that disadvantaged the surviving wife, this study examines the inadequate protection afforded to the surviving wife in inheritance and in a hypothetical divorce case in China. It is based on a systematic comparative legal analysis of the relevant inheritance and family law institutions in China, Germany, France, as well as England and Wales. With regard to Chinese law, the study also takes into account the practical implementation, historical development, and cultural background of the relevant legal institutions within the doctrinal framework. It thus provides profound insights not only into Chinese family and inheritance law, but also into Chinese society.
