Zum Umgang mit Massenverfahren in der Ziviljustiz

The dissertation examines the phenomenon of mass proceedings before the civil courts and the possible ways of dealing with them in the past, present and future. In addition to current developments in legislation, such as the leading decision procedure, the author also looks at historical solutions, such as the proposal to introduce a court for binding interpretation of the law into the court hierarchy, or the expert opinion practice of the Federal Fiscal Court up to the nineteen-sixties. The author concludes his work with a draft law to submit legal questions from the complex of mass proceedings in isolation to the Federal Supreme Court for a decision, which would then be binding for the courts of lower instances.
