Zur Strafbarkeit von digitalem Hass

This work is about derogatory and threatening statements made online. An interview study with victims and perpetrators formed the basis for the subsequent examination of the criminal liability associated with this phenomenon. The author investigates what difficulties arise in the application of the law. To this end, an analysis of case files from several public prosecutor’s offices was conducted, covering proceedings under Sections 185 et seq., 130, 241, 111, 126 and 140 of the German Criminal Code, and was supplemented by interviews with experts. The thesis takes into account reforms that have already been implemented and offers further proposals for amending the substantive criminal law.
