The margin of appreciation doctrine is one of the central characteristics of ECHR case law. The book examines the hitherto little-discussed issue of transferability to the case law of the ECJ on internal market freedoms. Essentially, it provides a positivistic analysis of the case law of the ECHR and the ECJ respectively, assessing whether the ECJ practices such a transfer in whole or in part. While the first part of the research presents the legal foundations of the margin of appreciation doctrine and its application by the ECHR, the second part examines to what extent the ECJ grants discretion to the member states in its case law on internal market freedoms. The book concludes with a comparison and evaluation of the examination results.
