In this book, the author combines a theory of compliance and a constructivist approach to present an in-depth analysis of the process and outcomes of the transfer of selected articles of the General Data Protection Regulation (GDPR) in three non-EU countries, namely Norway, Serbia and Ukraine.
On the basis of her results, she argues why the commonly applied criteria of the Brussels effect do not provide satisfactory testimony to the normative power of the EU, and she offers a new approach to assessing the global diffusion of legal norms.
Geht die globale Verbreitung von EU-Normen mit einem Transfer der Rechtskultur und der Werte der EU einher oder existieren diese übernommenen Normen nur auf dem Papier? Das Buch kombiniert die Compliance-Theorie mit einem konstruktivistischen Ansatz, um eine eingehende Analyse des Prozesses und der Ergebnisse der Übertragung ausgewählter Artikel der Allgemeinen Datenschutzverordnung (DSGVO) in die drei Nicht-EU-Länder Norwegen, Serbien und Ukraine zu präsentieren.
Auf der Grundlage der interpretierten Ergebnisse argumentiert die Autorin, warum die Kriterien des Brüssel-Effekts kein zufriedenstellendes Zeugnis für die normative Macht der EU liefern, und entwickelt einen neuen Ansatz zur Bewertung der globalen Verbreitung von Rechtsnormen.
