Description
Everyone is familiar with whistleblowing, at least since the NSA scandal. The discussion about the legality of whistleblowing has gained new political and legal relevance due to the Whistleblowing Directive (EU) 2019/1937 and the German Whistleblower Protection Act (HinSchG), both of which affect not only employment relationships under civil law, but also civil servants. Against this background, this work deals with the changes in civil servant law resulting from the Whistleblowing Directive and the HinSchG, with a particular focus on the civil servant's duty of remonstration, the duty of follow-up and the duty of loyalty to the constitution and the resulting rights and duties with regard to whistleblowing.
