Beihilferechtliche Probleme im vorinsolvenzlichen Sanierungsverfahren

The influence of EU state aid law on areas of law covering company crises and insolvency proceedings, including reorganisation and restructuring options, is increasingly recognised as an obstacle to successful reorganisation or restructuring in reorganisation practice. Nevertheless, interest in this issue remains limited. The same applies to pre-insolvency reorganisation and restructuring law introduced in accordance with European requirements. In this study, the author examines the extent to which the legal requirements of EU state aid law influence the behaviour of public creditors in restructuring or reorganisation proceedings.
