Description
The expectant right to moveable property as a result of a purchase agreement subject to retention of title is known as the "essential minus to ownership" and has become an indispensable part of legal usage. The author uses the figure of the "Rechtsprädikat" to resolve the dogmatic inaccuracies of the law of expectancy and argues against classifying the institute as property law. The expectant right ultimately (only) describes the future ownership of the property right. Due to its non-property law classification, the expectant right must also be rethought in terms of conflict of laws. The introduction of the "Rechtsprädikat" will promote the correct application of the law in this context in the future.
