Description
The aim of the Act on the Standardisation of Foundation Law was to reform civil foundation law comprehensively and uniformly throughout Germany and to put an end to the legal fragmentation at state level. Most of the new regulations entered into force on 1 July 2023.
Against this background, the author examines the extent to which the reform lives up to its own claims and can lead to a positive development of the foundation landscape in Germany. In addition, individual aspects of the reform, such as the provisions on amendments to the articles of association and on foundation assets, are examined in more detail and advice is given for practical application.
