Verfahrensablauf und Geschäftsleiterhaftung unter Anwendung des StaRUG

With the entry into force of StaRUG and its core element, the restructuring plan, instruments for the restructuring of companies outside insolvency proceedings have for the first time been standardised by law. Due to this novelty, but also due to a significant change in the regulations as a result of the recommendation of the Legal Committee of the German Bundestag, there is a need for clarification in practice.
Against this background, this volume deals with the sustainable success of a reorganisation and the correct course of a company reorganisation within the framework of the StaRUG. It also answers the question of whether the use of the new reorganisation and restructuring framework leads to excessive liability on the part of company directors.
