The transfer of personal data in the secondary market poses a number of challenges: From a data protection perspective, the main question is whether and how data protection legitimacy can be established from the perspective of the buyer without direct contact with the data subject. From the perspective of the law of obligations, questions arise as to the nature of the contract and the consequences of a lack of legitimation under data protection law. Alisa Rank-Haedler examines these issues, taking a comparative approach to the law of obligations and using Italian law as a comparative legal system.
