Data is an essential competitive parameter for a growing portion of the overall economy. The new data access provisions in the Digital Markets Act, the Data Act, and the German Competition Act (GWB) aim to make data currently held by few companies – most of which have significant market power – accessible to the public and competitors to revitalize competition, generate better products, and ultimately, increase overall welfare. This dissertation examines these new data access regimes, highlights their shortcomings, and analyzes how they interact within the EU's multi-level system. Additionally, it looks to the United States and outlines current developments regarding data access there.
