Die Rechtfertigung medizinischer Notfallbehandlungen nicht ansprechbarer Patienten

When treating unresponsive patients, the sword of Damocles hangs over emergency medicine and those involved in it in the form of liability and criminal law. The aim of this thesis is to resolve the tension between the right of self-determination and the protection of life, which is becoming particularly virulent in criminal law. After a comprehensive review of the state of opinion in criminal law, an interdisciplinary approach is used to present an alternative solution. This approach is convincing due to the realization of both constitutional rights as well as the minimization of liability and criminal liability risks. The thesis also offers important guidelines for practical action and thus contributes to increased legal certainty.
