In this book, the author deals with issues relating to directors’ and officers’ liability insurance in the event of an insuring company filing for insolvency. As cases of directors’ and officers’ liability are becoming more and more common in legal practice, directors’ and officers’ liability insurance has begun to play an increasingly important role as well. Despite an extensive exploration of this phenomenon, there are still many unanswered questions regarding corporate law, but even more so in the specific situation of a business in crisis. In these special circumstances, corporate law, insurance law and insolvency law issues intertwine. The author examines the areas of law concerned in this respect in terms of their mutual interaction, and resolves contradictions across all the relevant areas of law. She also consistently takes into account practical requirements when considering dogmatic theoretical issues.
