Gemeinschaftliche Unterbringung von Lebens- und Liebespartner/-innen im geschlossenen Regelstrafvollzug

Does a couple detained at the same time have a right to a communal detention room? According to current law, this depends in particular on whether the couple is homosexual or heterosexual and in which federal state the couple is imprisoned. The central research question of this thesis is whether this differentiation is legally tenable and whether a claim to shared accommodation arises.
In particular, the author examines the current legal situation of prison accommodation as well as the significance of partnership and sexuality for the prison system. Based on the results, she analyses four groups of cases to determine whether the discretion of the authorities in deciding on placement results in a claim.
