Among lawyers, the perception that scandalized media reporting can subliminally influence criminal trials is almost unanimously shared. In spite of the consequences for ‚prominent figures’ on trial, who often experience intense reporting on their procedure as well as their social life, they often have to tolerate impairments of their individual rights for legal and factual reasons. The author questions this situation and proves the absense of a legal basis for the neglect of indivdual rights in the name of sensation and scandal.
